  1. Motorista is acting as a mere DSA/Car Dealer for Clients in selling New Private & Commercial Vehicles and providing Financial and/or Business Consultancy Services, or in accepting bookings for New Vehicles on behalf of various automotive brands/authorized showrooms.
  2. Motorista shall provide Free Attachment Service for New Commercial Vehicles to Fleet Vendors/Corporate Companies/Cab Aggregators. Motorista HOLDS NO RESPONSIBILITY OF BUSINESS PROPOSAL provided by Fleet Vendors/Corporate Companies/Cab Aggregators. Motorista, therefore, shall not be responsible for breach of contract due to any fluctuation in business package/rate per KM or any intentional or careless actions or comissions on part of such Fleet Vendors/Corporate Companies/Cab Aggregators, which result in any loss in income, loss or theft of vehicle, delay in payment or accidental damage to your vehicles.
  3. Motorista shall not be responsible of any mischief or any lack of communication between the Client and Fleet Vendors/Corporate Companies/Cab Aggregators. However Motorista would extend SUPPORT to such clients by Attaching their respective vehicles to any different Fleet Vendors/Corporate Companies/Cab Aggregators at NO EXTRA COST.
  4. Motorista shall not be responsible for any injuries, accidental damages, losses in commercial income, theft or losses caused by any driver provided by us under Free Service Category.
  5. Client Loan process will begin after making of MSME Establishment License irrespective of date when he/she booked the vehicle.
  6. CANCELLATIONS AND REFUNDS – We reserve the right to charge Motorista Service Assistance Processing Fees in the event of refunds, cancellations and other services. Refund would be provided by cheque after 20 working days of cancellation of booking with letter of request & original booking receipt.
  7. Please ensure receipt against all payment, No Claim would be entertained without original payments receipt.
  8. Down Payment Amount would depend on client documents, Cibil-Credit Score and bank approval.
  9. Once Loan is disbursed the vehicle cannot be Changed/Replaced/Cancelled.
  10. All Payments has to be made through Cash/DD/Cheque in favour of Motorista.
  11. 1% TCS (Tax Collection at Source) is applicable on the value of the Invoice of all vehicles with Invoice value greater than 10 Lakh Rupees.
  12. Vehicle will be delivered after the completion of Registration formalities as per MVACT/after loan disbursement.
  13. Price Subject to change without prior notice and prevailing at the time of actual delivery.
  14. RTO Registration includes Service Charges.
  15. In the event of any dispute with regard to this DISCLAIMER and / or the interpretation of any of the terms and conditions hereof and / or the implementation hereof, including questions of determination of any aspect hereof as may arise or become applicable, any and all other matters relatable to or arising out of the same, howsoever remotely connected, the same shall be referred to arbitrator. The Arbitrators decision shall be final and binding and all the parties being bound to forthwith implement the same. The arbitration shall be held at Mumbai and shall be conducted in accordance with the Arbitration and Conciliation Act, 1996
